Terms of Use
This is the agreement between you and Scope, which is named “Terms of Use” or “User Agreement” and may also be referred to as "agreement" herein. Before you use any of the websites presented by Scope or enter into any transaction with Scope or use any information offered or provided by Scope, you affirm that you have read and understand the agreement and that you agree with its provisions.
Scope Technologies, Inc is a Colorado corporation ("Scope") doing business using various websites, including but not limited to RoofScope.com, PaintScope.com, GutterScope.com, SidingScope.com, InsulationScope.com, ConcreteScope.com, and BlueprintScope.com. In this agreement, Scope may be referred to as "we" or "us" or "it" and may be referenced with appropriate possessive pronouns. A user of our website(s) may be referred to as "you" and may be referenced with appropriate possessive pronouns.
When you access and use a website operated by Scope, irrespective of the means by which you access such website, you confirm and agree to all of the following statements, terms and conditions (collectively, "provisions"). If you do not agree with any of the provisions of this agreement, then you are not authorized to use Scope’s websites, products or services; if you are unsatisfied with the performance of our website, products or services, your sole and exclusive remedy is to discontinue use.
Sharing Information
We regard your personal information as confidential. Please see our Privacy Policy, which is posted on our website. Scope will not sell, rent, share or disclose your personal information to any third persons. However, we may collect and compile information, including personal information, from users of our websites. We convert such personal information into impersonal data (and combine such data with information collected from other persons) for analysis to improve our marketing, personnel, and financial management. Such data compilations are the sole property of Scope.
We may compile and use IP addresses to analyze usage patterns and trends, manage and promote our websites, track users’ usage, and troubleshoot problems. Our systems autonomously and automatically log browser type, email access and open time, as well as URL requests and referrals. We do NOT link IP addresses to your personal information, and we do NOT disseminate any of this data to any third person. We may use cookies to facilitate and enhance your experience when using our website as well as to retrieve data from your usage.
When you register with Scope (and order products or services: collectively, "Report(s)"), we collect personal information, such as name, contact information, business address, and credit card information. Your information is securely managed and kept confidential; we use it to deliver your order, process your payment, and communicate with you about the status of your order and other important matters. Credit card information submitted with your order is used only for payment processing and is never retained on our website.
In response to court orders, subpoenas, or government investigations, we may be required to provide your personal information. We will report to law enforcement any activity that we believe is unlawful.
Lastly, we enter into agreements with a variety of other businesses in the construction industry verticals to introduce their customers to our array of products, services and reports as well as to introduce our customers to their products and services. These contractual arrangements are not partnerships in the legal sense, but the business world calls the parties to these relationships “partners.” And so, we call them partners, too. If you open an account through one of our partners’ landing pages, we may share with that partner the fact that you opened an account. If you are provided access to one of our partners' accounts and you purchase reports using that access, your purchases with Scope will be reported via our billing to that partner.
Security
We use systems and programs to optimize data security, both in its transmission and its storage. We access your account information to process your orders and to properly manage your payments; these processes are performed autonomously by our software without contemporaneous human intervention. Our software also automatically sends you information about Scope that we deem pertinent to your needs and interests.
You are solely responsible for allowing persons (e.g., your staff or your customers) to access your account ("Account Users" or "AU"). We strongly recommend that you securely keep both your account’s access name and its password confidential. It is important that you understand that you need not disclose either the account’s access name or its password to any AU because each AU can have its own login account access name and password, which you, alone, assign and link to your confidential account.
We recommend that you change your password frequently and whenever your circumstances change. When you add an AU to your account, you are responsible for initiating the link as well as managing, controlling and limiting their access to, and use of, your account. You are responsible for all Reports ordered through your account; each AU's usage is itemized for review. You must remove an AU immediately when you no longer want them to have access to your account.
Ordering Reports
Before you can order a Scope Report, you must first request that Scope open an account for your exclusive use. Upon your request for an account with Scope, you agree that Scope may communicate with you via email, SMS text messaging, and any other form of communication with non-solicited as well as solicited communications. You agree that Scope may contact you from time to time at any time for any business reason, including, without limitation in purpose, to confirm orders, to verify contact information, to make inquiries about account users and other account matters, and to deliver information about Scope, its services, Reports, special offerings, and other matters. To opt out of one or more of our communication channels, please go to the section entitled Contact Us at the end of this User Agreement.
To order an aerial measurement Report: enter the property address, coordinates, or use geo-locate to identify the property. Next, pinpoint the structure that you want to be measured and confirm your pinpoint. The Report that we deliver to you will always be processed from the pinpointed structure(s) even if you geo-locate or enter a different address. Notwithstanding, our Report will be labeled with the address that correlates to the parameter that you input. Scope is not responsible if you incorrectly geo-locate or incorrectly input the coordinates or address of the property to be processed. Nor is Scope responsible if you pinpoint a structure incorrectly; you are solely responsible for pinning the correct structure to be measured. If you make a mistake, please contact your Customer Experience Representative to help you with the most cost-effective resolution.
To order a BlueprintScope Report: upload your blueprint file in .pdf format or a zip folder of multiple .pdf files. For Scope to process your Report, the blueprint file must include the following: Roof Design, Roof Pitch, and Dimensions. These items are typically located on the Roof Plan, Elevations, and Floor Plan. If any of this required information is not provided, we will, in our sole discretion, either charge an additional fee to conduct the necessary design work or cancel the order. BlueprintScope Reports are limited to one main structure plus up to three auxiliary structures, which include residential garages, sheds, and gazebos. For blueprint files containing more than one main structure or one main structure with separate structural options, you must order a separate Report for each structure or option. Our Customer Experience Team may contact you to verify the scope of work and to facilitate your ordering process.
Delivery time is determined by Report type and Membership package. We endeavor to meet and exceed our stated delivery times, but occasionally, there are delays in production; such delays are generally due to factors beyond our control, such as extraordinary demand due to weather, internet malfunctions, or other phenomena.
We can expedite certain Reports for an additional fee; please contact your account manager or our Customer Experience Team for details.
If you order via email, over-the-phone, or SMS text message, Scope may delay your order so that we can verify the order details with you. You must promptly respond to our confirmation request to receive your order timely (the time for delivery starts when Scope verifies your order).
Pricing and Memberships
Background. Scope assigns standard prices for standard Reports (“Base Price”); these are the prices that are charged to our Pay-As-You-Go users and that are used as the starting point for all discounted pricing. Base Prices may change at any time, and they are immediately applied to all Users. When you place an order, a typical Base Price may be displayed, but your price for your Report may be different (see below). Please contact Scope’s Customer Experience Representative or your account executive or account manager for a current Base Price list.
Base Price for a Scope Report is determined by the size and type of the structural component(s) to be measured and the number of structures. When you place an order for a Report, you will input the property’s basic type (single family, commercial, industrial or multi-family). From that input alone, our automated system will initially estimate a charge for your Report (and display it at checkout). Because the size of the structure may exceed the size category that our system used to make the initial estimate, the charge for your Report may be for a larger size and therefore exceed that initial estimate. When you order a Report, you agree that you will not rely on that initial estimate and that Scope is not bound by it. You acknowledge that we will NOT notify you if the actual final charge for your order exceeds the initial estimate; and you agree to pay the final charge.
Scope offers three methods to order and pay for Reports.
All methods require that you first set up an account online. When you order a Scope Report, its price will automatically be charged to your account.
Pay-As-You-Go.
With Pay-As-You-Go, each Scope Report is a discrete and separate transaction. You order a Report; and we charge your account – debit or credit card – and deliver the Report. You have no additional obligation. When setting up your account, simply check the "Scope Easy Pay" box. We deliver your Report via email in .pdf format; you can print your report or display it on any compatible electronic device. Pay-As-You-Go Reports are charged at “Base Price” and as described above without discounts (excepting occasional direct response promotions with our coupon code).
Annual Membership.
To enjoy significant savings with Scope and to facilitate your expense forecasting and budgeting, Scope offers annual subscription contracts (“Annual Membership”). Annual Memberships are for a 12-month period and are generally paid in monthly installments (“Dues”) – you can also pre-pay and the Dues amount will be credited monthly when due. Scope offers several Annual Membership plans; each plan provides special bonuses, including substantial discounts on Reports and free services and features - the greater your annual commitment, the greater your special bonus package.
Dues are used first to purchase Reports and features that are included with your membership; after that amount is expended, you can continue to purchase Reports at the same discount rate that is included with the plan you chose. You need not use all your Dues amount in the month it is paid (or credited); unused Dues will carry forward. Your free services and features are available to you so long as your Dues are current.
Your Annual Membership is a 12-month, noncancelable, subscription agreement; you are responsible for paying each and every monthly installment. Once it starts, you cannot cancel or terminate it. Why? Because Scope plans to meet the demands of its annual memberships, and such planning requires our commitment for both capital and labor. Our investment in our infrastructure of leading-edge technology and proficient personnel provides you with the industry's most accurate reports and exceptional customer service.
Fulfilling our promise of excellence to you goes hand-in-hand with your commitment to Scope. To meet these goals and to best serve you now and in the future, you agree that your annual membership will renew automatically unless you notify us - at least 45 days before its anniversary date - to terminate at the end of the term (notify us at customerservice@myscopetech.com).
If you give proper notice to not renew your Membership, we will keep your account balance open for one year; you can use the balance in your account at Base Prices during that time.
You may upgrade your Membership at any time without altering your anniversary date and immediately start earning greater discounts and bonuses. On the other hand, you may not downgrade or cancel a Membership during its contract term. We do not refund your account balance if you cancel or terminate your Membership before the end of your commitment or if you don't use all your Dues. If you cancel or terminate your account for any reason before the end of your Membership commitment, you remain responsible for payment of your commitment even if you no longer order from us. Alternatively, in Scope’s sole discretion, if you fail to pay your Dues, all of the Report(s) that you have ordered and bonuses (discounts, services and features) that were available to you will be rebilled to you at Scope’s Base Price (you will forfeit your membership benefits and be retroactively charged and responsible for paying for all of Scope’s Reports and services at Scope's Base Price).
Pre-Payment.
Scope offers pre-payment plans for high volume users that want extraordinary savings and benefits without an annual commitment. With pre-pay, we offer bonuses that include substantial discounts on Reports plus enhanced delivery times plus many features and benefits not available to pay-as-you-go customers or other subscribers. These bonuses are based upon the amount that you prepay into your account; the greater the amount of your pre-pay, the greater the bonuses. Contact your account executive to learn more about how to dramatically increase the value of your dollars. Bear in mind, however, if you fail to expend the entire amount or use the features added to your account, you will not receive a refund; in addition, to avoid paying Base Prices and to continue to receive discounts and bonuses, you must renew your pre-payment amount before it runs out.

Payments
You may open (and maintain) an account with Scope using check (for Pre-Payments and Dues) or ACH and credit/debit card (for Pay-As-You-Go, Pre-Payments, Dues, Account Balances); we accept most major cards. We will only process an order when there is a sufficient balance in your account to pay for it. If, however, for any reason, your account balance reflects an amount due to Scope (e.g., because we have delivered an order without available, sufficient funds or have mistakenly charged your account for less than the actual amount due), you must immediately pay the balance then due. If you fail to pay on time, you will incur a late fee of $10.00 plus interest charges at the rate of 2% per month on the unpaid balance of your account, and you agree that you will be responsible and liable for any and all costs that we incur to collect such balance, including but not limited to attorney’s fees.
All our prices are in U.S. Dollars, and all payments must be made in U.S. Dollars. We will charge your credit/debit card a fee of 3% of the amount due for all amounts paid via credit/debit cards. We may, in our sole discretion, pause or terminate your account when it has an unpaid, past due balance or when you fail to provide an operable ACH Transfer connection or credit/debit card.
Cancellations and Refunds
You may cancel an order or cancel a portion of your order (e.g., remove a structure), but you must notify us either 1) before we begin processing your Report or 2) within 3 hours of your order placement, whichever occurs first ("Timely Notice"). Note: if you have requested an expedited Report, it is unlikely that it can be canceled. You will be charged the full amount for your Report if we do not receive your Timely Notice. To notify us that you wish to cancel your order, you must email your cancellation request along with the order-property’s address to customerservice@myscopetech.com.
As a courtesy, if we discover that you have ordered two identical Reports for the same property within a 24-hour period, Scope will cancel the second order automatically.
If your account is funded by a Pre-Payment or Membership, you will not receive a refund when your account terminates. You may not terminate a Membership during the membership period; it is an annual commitment, and it automatically renews unless you properly notify us to not renew. If you stop paying your Dues before properly terminating the membership, you will continue to be charged according to the membership agreement. If your membership expires in accord with your agreement with Scope and if there is a credit for an unused amount, you may use that credit at any time during a one-year period following the expiration of your membership (after a year, the credit will be forfeited).
Any refund of funds that originated with a credit card payment to Scope will be reduced by 3% if remitted to you by check or by 6% if the charge is reversed on your credit card.
Scope Report's Accuracy
Our Reports delineate dimensions and compilations of spatial areas that are very accurate: generally, 99% accurate. But sometimes the imagery is not suitable for us to produce this level of accuracy. Scope may post an inaccuracy warning in your Report, stating that due to the lack of suitable imagery, Scope cannot assure the accuracy of the Report.
You recognize and affirmatively acknowledge that inaccuracies in dimensions and/or spatial compilations are likely in your Report, and it is your responsibility to confirm the accuracy of a Report whenever you use a Scope Report. For this and other reasons, you agree that you will not publicly disclose the accuracy of any Report that you receive from Scope.
Sometimes the imagery, from which we measure to produce our Reports, does not represent what is present at the location you specify. An image generally displays the copyright of its producer, but any date displayed may not correlate to the date of the image. There may have been substantial change to the property between the date of the image's production and our Report that uses that image (e.g., there may have been demolition, addition, or alteration of structures). This fact is unknowable to Scope because all our imagery is provided by independent third parties that do not guarantee or promise up-to-date imagery. It is entirely your responsibility to determine the suitability of the imagery, take-offs, and measurements.
If you receive an aerial measurement Report that is substantially inaccurate, Scope offers 3 remedial options only: If you provide Scope with photographic evidence and actual field measurements, (1) we will prepare a revised report based upon your data and photography at no additional charge, or (2) you may request a credit to your account of your Report's purchase price and keep the Report without revision, or (3) if, under option (1), we cannot rectify a Report’s inaccuracy, we will credit your account with your purchase price upon your request. If you desire one of these options because of inaccuracy in your Report, you must request it within 90 days of Report delivery. These are your exclusive remedial options. We do not, in any manner whatsoever, guaranty the accuracy or content of our Reports; nor do we expressly or impliedly warrant that any report is suitable for a particular purpose.
ProScope Inspection Application
To produce a ProScope Report, we require certain data and measurements. ProScope is merely a tool for analyzing and compositing data; the data collection is solely your responsibility. You are responsible for, and assume all risks associated with, acquiring any measurements; you must obey all safety laws, rules, and regulations; you must contact the owner of the property to get the owner’s consent before accessing the premises; and you must properly secure and protect the owner’s data after acquisition.
When you order or request a ProScope Report, you authorize Scope to use, in its discretion, some or all of the property data you submit (but, of course, we will never use the data that you submit to create a Report to assist your competition). For example, we may use the data to improve the accuracy of Scope Reports, including but not limited to: RoofScope®, PaintScope®, SidingScope®, GutterScope®, ConcreteScope® or InsulationScope®. You may access the data that you submit for 12 months; after that time, it will be archived or destroyed. If we archive the data, we will charge a retrieval fee if you want access.
ProDocs
Scope offers estimating and invoicing documents (that you can customize with your own corporate identity) to assist you with project management: material specification, pricing, work and purchase orders, and customer presentation and billing. ProDocs automatically takes the data from your measurement Report -- e.g., your Roofscope report - and delineates them on the ProDocs form for your review and customization. After verifying and adjusting the measurements based upon your own observations, experience, and measurements and after confirming your labor and material choices, you can input your cost per unit for each variable as well as your estimated overage, overhead and profit; in just a few seconds you will have all of the materials that you need to present, close, perform and bill the project.
For businesses offering more than a single trade (e.g., roofing and painting) or using differing pricing structures (e.g., insured and custom retail), you can create any number of separate templates, each set up to produce documents for a separate trade and pricing system with the applicable end-use documents (customer estimates, customer contracts, scope of work, etc). From each template, you can generate customized estimates for your customer presentation, work and purchase orders for your suppliers and subs, as well as final customer invoices. You can customize these documents for your company; you merely input your data - name, address, phone, email. etc - and upload your logo.
Referral Rewards
Scope offers referral rewards to both you and the customer that you refer to us. Your referral must not be affiliated with your business, must not already be a Scope customer, and must be personally known by you. Scope will reverse a referral reward if it discovers that your referral is not new to Scope, or is affiliated with you or your business, or has been identified by you with unsolicited emails or other informational broadcast. Contact your account representative to find out about our referral rewards program.
Communicating with You
By submitting your information to Scope Technologies, Inc ("Scope"), you agree that Scope may contact you - at the email address(es) and/or the telephone number(s) that you provided - to share marketing information and offers related to products and services that Scope thinks will be of interest to you, using automated techniques and technologies including but not limited to recorded and SMS messages. You can unsubscribe at any time. See Opting Out in these Terms of Use.
Changing Terms & Conditions
Scope may modify the provisions of this agreement at any time for any reason, and you agree to be bound by them upon the date of their posting on the website. We may make these modifications without prior or contemporaneous notice to you; it is your responsibility, and you hereby agree, to review and verify your understanding of this agreement each time you use our website. Nevertheless, Scope may notify you of changes from time to time, and you may be asked to indicate that you have read and understand our terms and conditions as and when you place an order.
Third Party Links to Scope Websites
Scope’s website may contain links to other websites. These linked sites are not under our control, and we are not responsible for their content. We are not publishing or promoting their content. We do not review their usage policies or terms for, or conditions of, use, including but not limited to their privacy policy; nor do we monitor their content or offers. We do not share or endorse any opinions expressed or processes that are used or available on such websites. You agree that you are accepting all risks when you access such websites or provide personal information or any other information or data to such websites. Consequently, we encourage and advise you to read their security policy and usage agreement carefully.
If you upload data from a Scope Report or other Scope document to a third party or provide a link to Scope’s Report or other Scope document from which data may be accessed by such third party, and if such third party accesses, uses, processes or manipulates such data to produce any information, report, or document, you agree that such third party’s information, report or document is not produced by Scope, that Scope is not responsible for any such third party’s information, report or document, and that you accept all risks associated with the use of such third party’s information, report or document.
YOU ASSUME ALL RISKS INCIDENT TO, AND AS A CONSEQUENCE OF, ANY DOWNLOAD, OR ANY LINK TO ANOTHER WEBSITE FROM A SCOPE WEBSITE.
Third Party Property Data with Membership
Scope’s offers specialized property data with certain of our Memberships ("ProData"). This data is produced by Attom Data Solutions, LLC ("Attom") that compiles and statistically processes public information. The ProData content is not under our control, and we are not responsible for its accuracy or veracity and, along with Attom, Scope disclaims any liability for any errors contained in the ProData Sheet. You agree that the data is provided by Attom and Scope to you as-is, that you accept all risks when you use such data, and that you will indemnify and hold harmless Attom and Scope from any use thereof.
You agree that you will only use the data for your internal use and will not reproduce, sell, or publish any of the data. You acknowledge and agree that the data contains consumer information - which incorporates concomitant consumer rights to privacy and requires fair information protection practices on your part - that you will treat as confidential information, and that you will allow access only as needed to perform your internal business function. You acknowledge and agree that you will not use the data to evaluate or determine the creditworthiness of your customer or prospective customer or use the data as you would a consumer report.
YOU ASSUME ALL RISKS INCIDENT TO, AND AS A CONSEQUENCE OF, ANY USE OF OUR PRO DATA SHEET.
No Unlawful or Prohibited Use
You affirmatively state that you are at least 18 years old. You agree that you will not use any Scope website or product or service for any purpose that is unlawful or prohibited by the provisions of this agreement. You agree not to use Scope’s website in any manner that could damage, disable, overburden, or impair our website or interfere with any other person’s use thereof. Any attempt to reverse engineer any process used on Scope’s websites is prohibited. You agree that you will not create any link to any page of our website without our express consent.
Liability Disclaimer
All of Scope's Reports and all other documents provided by Scope for your use incorporate and/or include information, images, software, products, services and programs that are owned exclusively by Scope or used by Scope with permission from its owner. Each Report and document that is included in or available through Scope’s website may include inaccuracies and errors. You accept Scope's Reports and documents and the contents thereof "as-is" and acknowledge and affirmatively accept the likelihood of inaccuracy and error in Scope's Reports and documents.
We specifically exclude, and do not provide, any expressed or implied warranties whatsoever regarding the accuracy or usefulness of any statement or process contained in or accessed by this website or of any Report or document - the information, imagery, software, calculation, representation, description, drawing, product, service, or program - that you receive from Scope or through any of Scope's websites.
We disclaim any liability for damages, direct or indirect, consequential or incidental, foreseeable or unforeseeable, arising out of or in connection with our negligence or your use of this website or any Report or any document that you receive from Scope or through Scope's websites, including but not limited to: loss of business, loss of revenue or profit, damage to your computer or software or data, and any other damage or loss however raised (in personam, in rem, quasi in rem, or otherwise).
SCOPE MAKES NO REPRESENTATIONS REGARDING THE ACCURACY OF ITS REPORTS AND DOCUMENTS AND GRANTS NO WARRANTIES WHATSOEVER. SCOPE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, BY STATUTE OR OTHERWISE, SPECIFICALLY INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE USEFULNESS OF ANY REPORT OR DOCUMENT PRODUCED BY SCOPE. WE PROVIDE NO EXPRESSED OR IMPLIED WARRANTIES WITH ANY OF OUR REPORTS OR DOCUMENTS THAT INCORPORATE DESCRIPTIONS, CALCULATIONS, DRAWINGS, IMAGES, REPRESENTATIONS, MEASUREMENTS, SUMMARIES AND OTHER CONTENT.
SCOPE DOES NOT PROMISE, GUARANTY, REPRESENT OR WARRANT THAT ITS REPORTS OR DOCUMENTS ARE ACCURATE OR SUITABLE FOR YOUR USE, NOR DO WE PROMISE, GUARANTY, REPRESENT OR WARRANT THAT ANY REPORT OR DOCUMENT WILL BE DELIVERED OR AVAILABLE AT ANY PARTICULAR TIME OR WITHIN ANY PARTICULAR TIME FRAME OR THAT IT WILL BE DELIVERED OR AVAILABLE.
BEFORE YOU ORDER A SCOPE REPORT OR DOCUMENT, YOU AGREE, AS A CONDITION PRECEDENT TO SUCH ORDER, THAT SUCH REPORT OR DOCUMENT, WHEN DELIVERED, MAY CONTAIN ERRORS OF EVERY KIND AND NATURE, AND YOU ACKNOWLEDGE AND AGREE THAT YOUR EXCLUSIVE REMEDY FOR SUCH ERRORS IS ENTIRELY CONTAINED IN THIS AGREEMENT.
Termination or Limited Access
Scope may for any reason without notice terminate or restrict your access to its websites, IP addresses, or domains.
Indemnification
You agree to defend, indemnify and hold harmless Scope (and its directors, officers, subsidiaries, shareholders, affiliates, employees, agents, third party content providers, and licensors, and each of their respective directors, officers, employees, and agents) from and against all claims, liability, and expenses, including attorneys’ fees and legal fees and costs, arising out of your use of our website or your breach of any provision of this agreement. Scope reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any matter that may be subject to indemnification by you. You hereby agree that you will cooperate as fully as reasonably required in the defense of any claim.
Copyright and Trademark Notices
The content on our website is owned, patented, copyrighted and trademarked by Scope Technologies, Inc, or its use is otherwise permitted or authorized by its owner.
Upon our customer's request, we produce Reports using materials supplied by them (e.g., BlueprintScope). Whenever you submit materials to us, you expressly affirm, represent, and attest that you 1) solely possess the intellectual property rights, including but not limited to copyright, to all such submitted material, or 2) that you have been assigned such rights by all of the owners of such rights. When you place your order for a Scope Report, you agree that all such rights are waived and that all or any portion of the materials provided to Scope may be changed or used in Scope's Report. Further, you agree that Scope is the exclusive owner of all intellectual property rights in and to Scope's Reports, including but not limited to the use of the materials you provide.
Governing Law
The laws of the State of Colorado govern the provisions of this user agreement without giving effect to choice or conflict of laws principles, provisions or rules. When you use this website or purchase a Scope Report, product, or service, you attest that you have read and understand and consent to the provisions contained herein. The sole and exclusive jurisdiction and venue for any litigation arising out of this user agreement or your use of Scope’s services, reports, or websites shall be the state courts sitting in Denver County, Colorado, or the federal courts in the United States District Court for the State of Colorado, and the parties agree not to raise, and waive, any objections or defenses based upon venue or forum non conveniens with respect to such courts.
If any of the provisions (e.g., statements, terms, and conditions) herein shall be deemed invalid or unenforceable for any reason, then such invalid or unenforceable provision shall be amended to achieve as much of its original intent as possible or if not so amendable, then severed, and the remaining provisions of this agreement shall continue to apply.
A waiver by Scope of any act by you in contravention of any provision of this agreement, including but not limited to Scope’s failure to enforce its remedies (including but not limited to its right to terminate your usage of Scope’s website) shall not confer a waiver of a prior contravening act or infer a future waiver of a contravening act and shall not prevent Scope from exercising its right to enforce each provision of this agreement.
This agreement is binding upon and shall inure to the benefit of Scope, its successors, trustees, and permitted assigns. Scope may assign this agreement or any of its rights or obligations under this agreement with or without notice to you.
The headings in this agreement do not confer or infer any meaning of the content. Unless the context clearly and obviously requires otherwise, indication of gender is incidental and therefore means both genders or no gender, and similarly plural means singular and vice versa.

Opting Out
To opt out of one or more of the communication channels with Scope, please email your request-directive to optout@myscopetech.com. We can only provide two opt-out alternatives: 1) all communication via SMS or 2) sales and marketing promotions only. Be sure to include the exact contact number of each SMS channel of which you wish to opt out. If you wish to opt out of sales and marketing promotions, check the opt out box on the email you receive and/or email us with contact numbers (we cannot automate telephone number blocking, but we promise to use our best efforts to not call with promotional messages).
